Cigarettes and Other tobacco products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (COTPA 2003)


In the view of protecting non tobacco users from second hand smoke, to prevent minors from initiating tobacco use, to encourage tobacco users to quit and to overall control tobacco industries from advertising and promoting the use of tobacco products the Ministry of Health and Family Welfare, Government of India  passed this act known as Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act (COTPA), 2003 and is applicable to all products containing tobacco in any form and it extends to whole of India.

 

In the interest of public health, The Ministry of Health and Family Welfare had issued a detailed notification dated May 30, 2008, making rules under the cigarettes and other tobacco products (prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution Act, 2003) for the prohibition of smoking cigarettes and other tobacco products.


On October 2, 2008, the Indian Government expanded the prohibition on smoking in public places and workplaces to protect individuals from the hazards of second-hand tobacco smoke.
